Benefits of Guardianships
A guardianship allows a person to care for another who is unable to care for themselves. A guardianship may be over a person himself or over his estate. Although guardianships tend to be a very private matter, the information provided to the court to establish the guardianship will be shared with other "interested people." This can include other family members or close friends of the family. When we work with clients, we help them understand the best way to communicate this information, to keep private matters private, while still providing the notice to interested parties as required by law.
Appointing a Guardian
Guardianships function by giving another person the power to act on behalf of and protect the incapacitated adult or child while they are unable to do so on their own. Guardians can be other family members, the petitioner or a state representative. Our attorney works closely with clients to determine whether the client would be best served by a family member, petitioner, state representative or some combination. We also work with a court-appointed evaluator who gives recommendations regarding who should serve as the guardian.
